Energy Tec Holdings Pty Ltd (ABN 83 607 618 404) (Energy Tec) is subject to the Privacy Act (Cth) 1988 (the Act).

This document is the Privacy Policy of Energy Tec, developed pursuant to the Act, in relation to the collection, use and storage of personal information about you.

1. Introduction

1.1. Energy Tec Holdings Pty Ltd is committed to protecting confidential information and the privacy of individuals in accordance with the requirements of the National Electricity Rules, the Privacy Act 1988 (including the Australian Privacy Principles) and any other applicable regulations and procedures.

1.2. This policy sets out how Energy Tec Holdings Pty Ltd will protect confidential information and the privacy of any personal information held.

2. Confidential Information and Personal Information

2.1. Energy Tec Holdings Pty Ltd holds a range of confidential information. This information includes names, addresses, phone numbers, company associations and site-specific meter data. All confidential information is held strictly in accordance with the following Energy Tec Holdings Pty Ltd policies:

      • Information Security Policy (ITS001);
      • Password Enforcement Policy (ITS031);
      • Active Directory Rights and Roles – Role Based Security (ITS 008);
      • Information Management – Data Classification (IST 041).

2.2. These policies provide that only specifically authorised persons will have access to confidential information and such access will be appropriately password protected.

2.3. Some of the confidential information that Energy Tec Holdings Pty Ltd holds is personal information. Personal information is defined in the Privacy Act 1988 as information “about an identified individual, or an individual who is reasonably identifiable”.

3. Use of Information

3.1. Energy Tec Holdings Pty Ltd will only collect and hold personal information where necessary to carry out its operations, including performing functions required by law and other rules and procedures such as the National Electricity Rules.

3.2. This personal information may relate to:

      • Employment and human resources purposes. This includes, for example, résumés voluntarily sent to us;
      • Meter reading services. This could include names, contact information and metering data;
      • Customer-billing services. This could include names, addresses and financial information relating to an embedded network customer;
      • Providing debt management services. This could include, as well as the information outlined above, customer credit information;
      • Contract management services. This could include details of potential venders relating to a supply tender round;
      • Financial and accounting services. This could include information used in the preparation of accounts for a client;
      • Performance reporting services. This could include information about individual customer utility usage;
      • The performance of our functions in the Market Settlement and Transfer Solutions (MSATS) system. This could include wiring and installation information, National Metering Identifier (NMI) standing data, metering data and other information relating to embedded network customers;
      • Performing an obligation to collect information in order to comply with any law;
      • The health or safety of an individual;
      • A dispute resolution process.

3.3. Sometimes Energy Tec Holdings Pty Ltd will need to disclose personal information to third parties, such as:

      • contractors engaged by Energy Tec Holdings Pty Ltd for the purpose of performing its designated functions;
      • debt collection agencies;
      • regulatory bodies and government agencies; and
      • enforcement bodies (as defined in the Privacy Act 1988).

4. Types of Information

4.1. The personal information Energy Tec Holdings Pty Ltd collects may be of any kind necessary to fulfil the functions outlined above. Energy Tec Holdings Pty Ltd does not generally collect sensitive information (as defined in the Privacy Act). Though some exceptions include:

      • As needed in relation employees or contractors;
      • As needed in relation to health and safety. This might include, for example, sensitive information relating to a life support customer in an embedded network.

5. Holding of Personal Information

5.1. All information obtained by us is stored in a secure manner. We have adopted security measures and practices to try to ensure that all information is protected against loss, unauthorised access, misuse modification or disclosure.

5.2. When no longer required, personal information is destroyed in a secure manner, or archived or deleted in accordance with our obligations under the privacy act.

6. Access to information

6.1. You may request access to any personal information that Energy Tec Holdings Pty Ltd holds on you by contacting us (details below). We will take reasonable steps to respond to a request for access within 30 days and provide access in the manner requested, if it is practicable to do so. In some circumstances, Energy Tec Holdings Pty Ltd is entitled to refuse an individual’s request, for example where:

      • providing access poses a threat to other individuals or unreasonably affect their privacy;
      • where Energy Tec Holdings Pty Ltd is permitted or required to refuse access by law or court order;
      • giving access discloses information that is commercially sensitive;

6.4. We will update the information we hold about you upon receipt of such updated details from you.

7. Cookies

7.1. We collect information from our website using “IP Files”. When you visit our website our system records or logs your IP address, the date and time of your visit, the pages viewed and any information you download.

7.2. This information is used for our internal purposes to better customise our website and our services to you.
